Rustam Gubaidullin, the firm's lawyer, is representing Firdus Tyamaev in the criminal proceedings against Elvin Grey

Rustam Gubaidullin defends the rights of Firdus Tyamaev, Honoured Artist of the Republic of Tatarstan.


Tatar-Bashkir pop star Alvin Grey (Radik Yuliakshi) accused our trustee of inciting interethnic hatred by posting a voluminous post on his Instagram page.

"I drew a conclusion that this individual, instigated by a certain group (I can give you the names for the competent authorities), who stirred up the water in Tatarstan, playing off ethnic groups in the republic, moved to Bashkortostan to stir up our people, setting Tatars against Bashkirs and vice versa. We will not allow it in our republic! You don't go in someone else's monastery with your own mouth," Yuliakshin wrote.

He also advised his colleague "to pick his brains and not to stir up interethnic discord in the republic" and also pointed at what Tyamaev, in his opinion, did "wrong" - in particular, "refused to sign the route sheet", "illegally entered the back premises", "held an unauthorized concert" and did not sign a contract with the AC. "Without a contract, what can he charge?! Gave a hand to the director of the REC or the head of the culture department... Those, of course, did not refuse, all past the cash register...". - Gray wrote.

"In some of his formulations Radik Yuliakshin allowed phrases of an offensive or slanderous nature, namely that he said that no contract had been concluded with the Palace of Culture in the village where the concert was to take place. He said: "Without a contract, what can he claim, he gave his hand to the director of the REC or the head of the culture department. My trustee thought that 'groping' was an everyday expression [that means] that he 'bribed, bribed'," said the firm's lawyer.

This is the fact that a police report was filed. "In our opinion, Yuliakshin committed an offence under Part 2 of Article 128.1 - 'Defamation committed publicly using the internet'," Rustam Gubaidullin explained.

However, the investigator of Vishnevsky police department did not find the arguments of the lawyer convincing and issued a decree refusing to initiate a criminal case. In it he indicated that it had not been possible to question Mr Yuliakshin during the enquiry because his whereabouts were unknown and also concluded that there was no defamation.

The firm's lawyer pointed out that these arguments were unfounded, as Radik Yulyakshin was a public figure and to say that it had not been possible to establish his whereabouts was unacceptable. In addition, all the signs of a crime are there, i.e. on the page, and the post has still not been removed.

As a result, the Prosecutor's Office of the Vakhitovsky District of Kazan reversed its decision not to prosecute the case and sent the case file to the police for further investigation.
